| Docket Entry: | This Case Management Order shall apply to all cases currently pending and subsequently filed in this mass tort program in this Court. 1) Global docket: This case has been assigned to the Paraquat Products Litigation mass tort program. A global docket related to the Paraquat Products Litigation mass tort has been established at 220500559. The global docket serves as a depository for the filing of pleadings, motions, orders, and other documents common to all cases in mass tort litigation. Counsel are expected to familiarize themselves with the orders and documents on the global docket and to regularly check the global docket for developments and additional case management orders entered in the mass tort litigation. a) The global docket, and the pleadings thereon, are publicly available by visiting https://www.courts.phila.gov/common-pleas/trial/civil/ and selecting ?Complex Litigation Center? from the list, clicking to expand the ?Mass Tort Programs? list, and then selecting the appropriate program. 2) Liaison counsel: The Court will appoint liaison counsel to represent the interests of the plaintiffs and the defendants on administrative matters related to this mass tort. Only liaison counsel may enter an appearance on the global docket; accordingly, liaison counsel are expected to forward any documents that are filed on the global docket to their respective constituent groups. The names of liaison counsel will be listed in Case Management Order No. 2, which will be filed on the global docket. Upon the filing of a case, or upon being served with original process in a case assigned to this mass tort, the parties or their counsel are instructed to contact their respective liaison counsel. If a party, or their respective counsel, has any questions or concerns related to this mass tort litigation, those questions or concerns should first be addressed to their respective liaison counsel. a) Liaison Counsel are expected to create and maintain an email distribution list and provide the distribution list to the Court for the Court?s use. 3) Status conferences: The Mass Tort Team Leader will hold periodic status conferences that shall be attended by liaison counsel. Liaison counsel shall provide an agenda to the Mass Tort Team Leader at least 48 hours in advance of the status conference. If exceptional circumstances exist such that non-liaison counsel wish to attend a particular status conference, then such a request shall be made to their respective liaison counsel who shall then forward the request to the Mass Tort Team Leader. 4) Court events: Unless otherwise notified, all court events, including status conferences, will be in-person in City Hall. The Court cannot accommodate requests for hybrid participation wherein some participants appear in person while others appear using video conferencing technology. 5) Mass Tort Motions Procedures: The Mass Tort Team Leader has adopted certain motions procedures that are applicable to all cases pending in the non-asbestos mass tort programs. A copy of these motions procedures is attached as Exhibit A. 6) Pro hac vice motions: All candidates seeking admission pro hac vice, and all Pennsylvania-barred attorneys intending to serve as the sponsor for a candidate seeking admission pro hac vice, are instructed to familiarize themselves with the applicable rules related to admission pro hac vice including, but not limited to, Pa.R.C.P. 1012.1, Pa. B.A.R. 301, and 204 Pa. Code ? 81.503. Motions for admission pro hac vice must be filed on the docket of the individual case in which the candidate is applying for admission; motions for admission pro hac vice shall not be filed on the global docket. 7) Motions in limine: Before filing any motions in limine, trial counsel shall provide their opponent with a list of the motions in limine they intend to file. Liaison counsel and trial counsel shall meet and confer as to which motions in limine are global and which are case-specific. Additionally, trial counsel shall meet and confer to determine whether any of the motions can be resolved by agreement. 8) Stipulations to dismiss or discontinue: If a plaintiff has agreed to stipulate to the dismissal of a defendant, the defendant (the ?Stipulated Defendant?) shall prepare a stipulation of dismissal. The Stipulated Defendant shall circulate the stipulation of dismissal to all defense counsel by letter, stating that any party has 10 days from the date of the letter to object to the dismissal of the Stipulated Defendant. If a party objects to the dismissal of the Stipulated Defendant, the objecting party shall notify the Stipulated Defendant in writing of the basis for the objection. If, after the expiration of the 10-day period, no objections are received by the Stipulated Defendant, the stipulation of dismissal may be electronically filed with the Court as unopposed. The electronically filed Stipulation of Dismissal must be accompanied by a cover letter stating no objections have been raised within the 10-day period as well as a copy of the dismissal letter. Service of the Court-approved Stipulation of Dismissal shall be effectuated via the Court?s electronic filing system on all parties of record. Any defendant who settles with the plaintiff and desires to have the matter marked discontinued as to that defendant may follow this procedure or, in the alternative, file a motion as set forth in Rule 229(b) of the Pennsylvania Rules of Civil Procedure. 9) Contact with the Court: All communications with the Court that are not filed of record should be directed to the Mass Tort Program at masstort@courts.phila.gov. 10) Miscellaneous: The Court expects all counsel to amicably resolve any issues that arise as a result of the implementation of this order. The Court may make exceptions to any procedures or protocols set forth in this order in special situations, sua sponte or on written request, electronically filed with service upon all parties, of counsel upon showing extraordinary cause.
